He discovered that a Jouserand de Mâcon was knighted there in 1321, with subsequent family members bearing the name “de Mâcon” as a sign of respect. When the family moved to the New World is not known, although Dodd believes that a French Huguenot with the name “Macon,” spelled without the accent mark or the “de” settled in the Middle Plantation in Virginia in the seventeenth century.

When Burr was tried in August 1807, Luther Martin, the famed Federalist who was one of Burr’s defense counsel, told the court that “Col. Burr and Gen. Dayton, he insisted, could not be convicted in this charge of misdemeanor, even if there had been one committed, because they were at a great distance. ” Despite pressure brought externally on the judge in the case - here, it being Chief Justice of the Supreme Court John Marshall by President Jefferson for a conviction, Marshall eventually found, in Burr’s case only, that there was not enough proof to sustain the indictment.
