These civil and criminal law consequences are quite different. In the case of a tort, liability is owed to the injured party and damages may be paid to the injured party to compensate for any losses. In the case of a crime, liability is owed to the state and the state supervises any punishment. Liability is owed to the state even where the crime has a human victim, because a crime is regarded as a breach of public order.

It is easier to explain these different functions in the context of a trial on indictment, but the same principles apply to a summary trial. If the defendant pleads guilty to the offence with which he is charged then the jury have no role to play and a conviction will be entered. A defendant who pleads guilty may be influenced by the fact that a guilty plea may well lead to a lesser sentence. It may also be that if a defendant pleads guilty to a lesser crime then the prosecution will not pursue a more serious charge; this is commonly known as ‘plea bargaining’.

3 Theories of Culpability As you can imagine, there are many different theories on how to assess culpability and some of them have been developed to a high degree of sophistication. They have been expressed in many different ways and can only be discussed here in very bare outline. It is not possible to say that one of them is the ‘right’ theory or that the law clearly follows only one of these approaches.
